Carpenter Technology and Allegheny Technologies Dispute Patent Validity

Carpenter Technology Corporation today announced that it has filed a lawsuit against Allegheny Technologies Incorporated (ATI) alleging that two U.S. patents obtained by the latter are not valid.

Carpenter filed the lawsuit in the United States District Court for the Eastern District of Pennsylvania in Philadelphia to challenge the validity of two U.S. patents, namely 564 and 858, issued to ATI regarding a method of producing and manufacturing thirty inch large diameter 718 ingots of nickel based alloys.

Carpenter is seeking a declaration that it has not infringed on or is not infringing on the patents and seeks an order that the patents issued to Allegheny are not valid.

Carpenter manufactures and sells ingots of various dimensions of a nickel base 718 alloy at its Reading, PA manufacturing location. It sells these products primarily into the aerospace market, where demand currently exists. Before the issuance of the patents, Carpenter made substantial preparations to produce nickel base 718 Alloy ingots in sizes greater than 30 inches in diameter, according to the complaint.
